Article 1. Scope

These Terms of Use (the “Terms”) set out the conditions for viewing the official website (https://www.ainsel.co.jp/; the “Website”) operated by AINSEL Technology Corporation (株式会社エインセルテクノロジー; the “Company”), using its content, making inquiries through it, and submitting skill sheets as instructed by the Company. Please review these Terms when using the Website.

The terms of individual transactions involving SES, engineering support, contracted services, partnerships or other arrangements are governed by separate agreements between the parties. These Terms do not change the scope of work, fees, allocation of responsibilities, confidentiality obligations or other conditions in such agreements.

Article 2. Website information and inquiries

The Website provides information about the Company, its services and partnerships. Listed technologies and experience do not guarantee that every engineer can work with every technology, that specific personnel are available, or that participation or results are guaranteed at a particular time or under particular conditions.

Sending an inquiry or skill sheet, or receiving our response or guidance, does not by itself form an agreement for work, project participation, partnership or another transaction. Availability, work scope, team structure, fees and other conditions are determined through individual discussion and agreement. Where the parties have separately agreed how a contract is formed, that agreement applies.

Article 3. Intellectual property

Copyrights, trademarks and other intellectual property rights in the Website’s text, photographs, images, logos, diagrams, designs and other content belong to the Company or the respective rights holders. Except for private use, lawful quotation or other uses permitted by law, you may not reproduce, republish, modify, distribute or publicly transmit such content without the rights holder’s permission.

Article 4. Prohibited conduct

The following conduct is prohibited when using the Website.

  • Conduct that violates laws or public order and morals.
  • Infringement of the intellectual property, privacy, reputation, creditworthiness or other rights or interests of the Company or a third party.
  • Unauthorized access, transmission of malware, exploitation of vulnerabilities or other conduct that interferes with secure operation of the Website.
  • Placing a substantial load on servers or networks through excessive automated access or similar conduct.
  • Impersonation, submission of false information, or unauthorized transmission of third-party personal or confidential information.
  • Unjustified interference with operation of the Website or the Company’s business.

Article 5. Inquiries and personal information

Provide accurate information to the extent needed for a response. Do not transmit other people’s personal information, client names, non-public project details or contractual confidential information without first confirming the necessary authority, consent and submission method. Submit detailed materials such as skill sheets only after we explain the permitted sharing scope and submission method.

We accept inquiries through the Website’s dedicated contact forms. Before entering and submitting information, review the purposes of use shown on the form and our PRIVACY POLICY. Personal information obtained by the Company is handled in accordance with our Privacy Policy.

If we invite you to submit a skill sheet, please use the SKILL SHEET FORM (Google Forms; Japanese, external site) . A Google account sign-in is required, and responses and files are stored in Google Forms and Google Drive managed by the Company. The form states accepted file formats and sizes and the purposes of use. If submitting someone else’s material, confirm that you have explained the handling to the individual, obtained their consent and have authority to submit. Submission alone does not constitute consent to disclosure of personal data to clients or other recipients.

Depending on the inquiry, a response may take time or we may refrain from responding individually. This does not limit our obligations to respond to requests under Japan’s Act on the Protection of Personal Information or other applicable laws.

Article 6. External websites and links to this Website

Third-party websites and services linked from this Website are provided under their operators’ responsibility and terms. The presence of a link alone does not constitute a guarantee of content, affiliation or recommendation by the Company. Any responsibility arising from our own conduct under law is governed by the applicable provisions.

When linking to this Website, avoid presentations that falsely suggest affiliation or approval, links from pages containing unlawful material, or framing and other methods that obscure the source or rights involved. Destination URLs and content may change.

Article 7. Website changes and interruptions

We may change the Website’s content or functions, or suspend or discontinue publication, due to updates, system maintenance, incidents, disasters or other circumstances. Where possible, we will announce significant changes or planned interruptions in advance on the Website or by other means. Advance notice may not be possible in emergencies or similar circumstances.

Article 8. Information and liability

We endeavor to keep Website information accurate and current. However, it may differ from actual circumstances due to update timing or individual conditions. Please confirm directly with us any conditions necessary for business or work-related decisions.

If damage related to use of the Website arises from a cause attributable to the Company, we bear responsibility in accordance with Japan’s Civil Code, Consumer Contract Act and other applicable laws. These Terms do not uniformly exempt the Company from liability for damages or limit users’ rights recognized by law.

Article 9. Changes to these Terms

We may review these Terms following legal changes or changes to the Website. Changes and their effective dates will be announced on the Website or by other means. Where consent or other legal procedures are required, we will follow them. A change alone will not be used to disadvantageously alter rights or obligations that arose before it.

Article 10. Governing law and disputes

Japanese law applies to these Terms and use of the Website. If a dispute arises, the parties will first endeavor to resolve it through good-faith discussions. If litigation is necessary, the dispute will be resolved by a court with jurisdiction under law. If part of these Terms is held invalid, the remaining provisions continue to apply to the extent permitted by law.

Article 11. Contact information

For inquiries about the Website or these Terms, please use CONTACT. For personal information handling and requests for disclosure or similar action, please contact the office listed in the PRIVACY POLICY.
